‘ONCE
CASE IS WITH CBI, I WILL REVEAL EVERYTHING’
Dy SP IK Yadav,
who probed the killing of Sameer Khan, tells Ashish Khetan
the truth
 |
| |
‘such a shot can
only be fired from close range. That means the deceased didn’t
have a revolver’ |
Tehelka: Please
help us
Yadav: You don’t
have a copy of the plea, no?
Yes, it is
with the lawyer who says Sameer was nabbed…
Don’t you have
that plea which says Sameer Khan tried to kill policemen and was killed
in retaliation?
We have the
FIR copy. We also have the other thing.
The court did not
accept that he was a terrorist. The high court also dismissed the case.
But don’t you have Sameer Khan’s plea?
What can
we do now?
You go to the Supreme
Court and submit a plea saying that he was arrested from Gita Mandir locality
and was killed on such and such date. This is also written in the plea.
He was nabbed
on the 27th.
It’s all right.
He was kept here till the 30th, he was kept in this or that place. So
why was he not caught in the first instance. This is also written here
(pointing to Chittaranjan Singh’s original letters). It will be
favourable to you.
But they
(Singh’s letters) do not have any signature?
It’s not needed.
How will the
court be convinced these are genuine documents?
The court should demand
genuine papers. You should tell the court that Yadav did the investigation.
But when he started questioning and was about to reveal that the encounter
was a fake, the investigation was handed over to another officer.
To whom?
It was given to Sharma.
He met Vanzara and the case was distorted and suppressed. Sameer Khan
sustained a bullet here (on the right temple) that pierced through there
(lower part of the back of the head).
Who did he
(Sharma) meet?
He met Vanzara and
case was distorted and suppressed.
Yes.
If they say they shot
someone from a distance of six feet then the person who shot should also
be 10-11 feet tall for the deceased to sustain a bullet injury here (on
the temple). Otherwise, such a shot can only be fired from close range.
That means the deceased didn’t have a revolver. If he had had a
revolver, they would not have shot him from so close. Second, he sustained
three bullet injuries and one pierced through here and another through
there (pointing to his ribs). If you will see this in the light of the
doctor’s report, you will see black powder was found there (on his
bullet wounds). This is only possible if he was shot point blank. So this
was a fake encounter.
How many bullets
did they fire?
Three. One was fired
at him (on his left rib), another here (right rib) and one here (head)…
If he (Sameer) did open fire on the police, it must be somewhere but we
didn’t find any traces.
Was the post-mortem
conducted?
Yes. It was.
What did
the report say?
It said that bullets
travelled through this part and that… and it said that he was wearing
a tericot shirt not cotton and the shirt was burnt by bullets.
What does
this mean?
It means that the
clothes can have burn marks only if the bullet was shot from a point-blank
range.
Did these
people lie about the cloth being cotton? They lied.
Yes, they lied.
Are all these
facts not in your investigation?
Yes, I have all the
facts. But only if they ask can I give them. The case was any way given
to someone else.
Hope the files
haven’t been burnt.
They can’t
burn it.
You said
that you were about to arrest him once and Sharma did all his investigation
sitting in Vanzara’s office.
Yes that’s
right. It’s all written in his (Sharma’s) diary.
Is Vanzara
accused in this?
He is accused in
this case. He was behind the whole episode, his letters also prove that
he is responsible for this incident.
What did he
write in the letters?
When I had written
to him, he replied that my investigation was going on the wrong lines.
He said he (Sameer) visited Pakistan. I asked him to provide the e-mail
that Sameer had received. He (Vanzara) replied in writing that he had
no e-mail.
But he said
in court…
All false things
were prepared. They will be trapped in their own web later.
Did he also
threaten you?
Yes, he had said
that I would end up as a corpse.
What did he
mean by that?
He meant that if
I didn’t comply with his wishes, I would be killed. I told him that
I will be sitting here till night and he may come and see me. Vanzara
called and I said that I was waiting for him since evening.
How long
was the case with you?
About five-six months.
Did you mention
the post-mortem report in your investigation?
Yes, it has everything.
Does it have
Tirth Raj’s report?
Get this done first.
Once the case is with the CBI, I will reveal everything when they take
my statement.
What is there
in the post-mortem that we can mention in our plea?
The most important
thing in it is that he was shot through his clothes and one bullet pierced
through to that part and gunpowder traces were present on it. They had
shown that he had a revolver when he was shot and that they had shot him
from a distance. But the powder was there on the clothes. It is only possible
when he is shot from a point-blank range. The tericot shirt will be burnt
only if he was shot from nearby. And there were four other inspectors,
they could have shot him when he was snatching the revolver.
Why was Sameer
killed? What could be the reason?
They killed him just
so that they could become heroes and earn Narendra Modi’s favour.
Why did they
have to kill him?
This is all a political
game.
Tirth Raj
told us that he held the DGP and everyone guilty in his report?
Yes, that is absolutely
right.
He told us
that papers were changed. He said that these papers were meant for PP
Pandey and the changed papers were addressed to DCP Crime.
He’s right,
they were changed. Don’t bother about all these issues, they are
there in my report.
